Reseller Terms & Conditions

To become a BlueStream reseller, you must click agree at the bottom of the page to the following terms & conditions. This agreement is between you (the ‘reseller’) and BlueStream Communications. The date this agreement is effective is on completion of the sign up form.

TERMS OF AGREEMENT

This agreement between you and BlueStream Communications is in effect for an indefinite amount of time, but is subject to cancellation or termination at any time by written notification by either party. From time to time, BlueStream Communications may change the terms and conditions of this agreement, and will notify you by email that such a change has taken place. By continuing to hold your reseller account after such notification, you become bound to the new terms and conditions.

PAYMENT

BlueStream will pay you the agreed commission rate of the ex-GST component at the time that the customer is invoiced (if you are not registered for GST) or on receipt of a valid tax invoice (if you are registered for GST). In the event that a customer needs to be issued a credit note and you have already been paid, you will be required to refund us the agreed commission rate of the refunded amount. Payments may take up to 7 days to be processed and will be paid by direct deposit into the nominated bank account.

USE OF BRAND

BlueStream resellers are required to make potential customers aware that they are reselling the BlueStream product, but that they themselves are independent of BlueStream entirely, are not employees or representatives of BlueStream directly, and cannot speak on behalf of BlueStream in any way. You must be an approved reseller before you may represent yourself as a BlueStream reseller. The use of the BlueStream or vControl brand or marks in any print or digital display (such as a website) is strictly prohibited unless written approval is given by a BlueStream representative.

LIMITED LIABILITY

BlueStream Communications shall not be liable under any circumstances for any damages of any kind arising out of or in any way connected with this agreement, the use of any BlueStream service, or the use of any BlueStream product. Damages include but are not limited to lost profits, loss of use, lost data, loss of privacy or damages to third parties.
